VP Dick Cheney is against any restrictions when it comes to the handling of detainees. He is hoping to defeat a bill that Sen John McCain is introducing that would ban torture and inhumane treatment of prisoners. When Cheney couldn't find support to defeat the bill, he asked McCain for an exemption for the CIA.

He even went as far as having e-mails from the National Security Council staff to the national security adviser, forwarded to him, sometimes without the knowledge of the author of those e mails.

And it was Cheney who picked Gitmo as the place to keep the detainees, possibly out of the reach of American courts.
